Consumer, Building and Occupational Services (CBOS), is currently reviewing the Second-hand Dealers and Pawnbrokers Regulations 2016 (the Regulations). Tasmanian regulations are required to be remade every decade, and the Regulations will expire in June 2026.
We are seeking input from stakeholders to ensure updates reflect community and stakeholder needs. It is our intention to collaborate with the affected stakeholders directly to achieve this.
We specifically seek your views on the following questions:
- Can the details that dealers need to keep be simplified? (see regulation 6(c))
- Should the minimum value of goods that require record keeping be increased from $50? (see regulation 6(a) and regulation 7)
- Should the current $100 limit for forfeited goods be increased? If the item is worth more than $100, it must be sold at auction (see regulation 9)
- Can the prescribed forms used by Police and traders be made easier to use? (see regulation 7(c))
- Is there anything else in the Regulations that needs to be varied, added or removed?
Please note that this is only the first step in our consultation process. Further consultation, including draft documentation or proposed changes, will occur as the process progresses.
